Title 5 BUSINESS LICENSES AND REGULATIONS
Chapter 5.24 TRANSIENT MERCHANTS*
5.24.050 Application and application fee.
Applicants for a license under this chapter must file with
the city clerk a sworn application in writing on a form to be furnished by the
city clerk, which shall contain, but not necessarily be limited to, the
following information:
A. Name and description of the applicant;
B. Address (legal and local);
C. A brief description of the nature of the business and the
goods to be sold, and in the case of products of farm or orchard, whether
produced or grown by the applicant;
D. If employed, the name and address of the employer,
together with credentials establishing the exact relationship;
E. The length of time for which the right to do business is
desired;
F. If a vehicle is to be used, a description of the same,
together with license number or other means of identification;
G. A current driver’s license or a photograph of the
applicant, taken within sixty (60) days immediately prior to the date of the
filing of the application, which picture shall be two by two inches showing the
head and shoulders of the applicant in a clear and distinguishing
manner;
H. The names of at least two reliable property owners of the
city, who will certify as to the applicant’s good character and business
responsibility or, in lieu of the names of references, any other available
evidence as to the good character and business responsibility of the applicant
as will enable staff to properly evaluate such character and business
responsibility;
I. A statement as to whether or not the applicant has been
convicted of any crime, misdemeanor, or violation of any municipal laws, the
nature of the offense and the punishment or penalty assessed therefor;
J. Proof of the possession of a transaction privilege tax
identification number as issued by the state of Arizona;
K. A statement of the physical location or locations within
the city to which the applicant will limit conduct of business;
L. Prior to issuance of license the city clerk shall verify
the location and type of business with the appropriate city zoning official.
Zoning review shall take no more than three working days. Any exceptions to the
license stated by the zoning official is grounds for the denial of the license
by the clerk;
M. Every person making application for a license has the duty
to provide truthful and accurate information in connection with the application
process.
N. Any suspension or revocation of a business license within
this state against the applicant within three years preceding the date of
application with the clerk is grounds for denial of the license by the clerk.
